Decisionofthe DisputeResolutionChamber passedon26October2023 regardinganemployment-relateddisputeconcerningtheplayerIzuegbuAbonimaBoniface BY: CliffordJ.Hendel(USA&France),DeputyChairperson JorgeGutiérrez(CostaRica),member StellaMarisJuncos(Argentina),member CLAIMANT: IzuegbuAbonimaBoniface,Nigeria RepresentedbyMrChijiokeOkpanku RESPONDENT: MaghrebAssociationSportive,Morocco I.Factsofthecase 1.On2August2023,theMoroccanclubMaghrebAssociationSportivedeFes(hereinafter:cluborRespondent)sentanofferofanemploymentcontract(hereinafter:theOffer)totheNigerianplayerIzuegbuAbonimaBoniface(hereinafter:Claimantorplayer). 2.PursuanttotheOffer,thedurationoftheprospectivecontractwasstipulatedasfromthedateofsignatureuntil30June2025. 3.Furthermore,thefinancialconditionsoftheabovementionedOfferwereasfollows: -AnnualsalaryofUSD80,000fortheseason2023-2024; -AnnualsalaryofUSD100,000fortheseason2024-2025. 4.TheOfferequallystipulatedthattheClaimanthadtopassamedicalandphysicaltesttocertifythathewasabletoplayfootball,inorderfortheeventualcontracttobevalid. 5.Onanunspecifiedday,theClaimantreceivedaninvitationletterfromtheEgyptianclubIsmailyFCtoplayforthelatterclub. 6.On11August2023,theClaimantandtheRespondentsignedanemploymentcontract(hereinafter:theContract)validasfrom11August2023until30June2025. 7.PursuanttotheContract,theClaimantwasentitledtoamonthlysalaryofMAD35,000,aswellasasignaturebonusofMAD400,000,payableintwoseparateinstalments: -MAD300,000on11August2023; -MAD100,000on30June2024. 8.Furthermore,theClaimantwasentitledtoaperformancebonuspaymentofMAD560,000,proportionaltothenumberofmatchesplayed,forthesecondseason(i.e.2024/2025). 9.AccordingtotheClaimant,theRespondentrefusedtoprovidehimwithacopyoftheContractsignedbybothparties. 10.OnthesamedaytheContractwassigned,theClaimanttravelledtoMoroccotocompletemedicalandphysicaltests,usingaflightticketprovidedbytheRespondent. 11.FollowingthesignatureoftheContractbytheClaimant,thelatterwas,accordingtohimself,consistentlytrainingwiththeRespondent.AccordingtotheClaimant,atthistime,nofood,drinkoradequatelivingconditionswereprovidedbytheRespondent.TheClaimantequallypointedoutthat,duetothesecircumstances,hefellill,towhichthe Respondentreactedbyallegedlyorderingtheteamdoctortoprovideunprescribedmedication. 12.On22August2023,theRespondentinformedtheClaimant’sagentthathewasnolonger needed,astheheadcoachdidnotdeemhisperformancesufficientforthelevelrequired. II.ProceedingsbeforeFIFA 13.On23August2023,theClaimantfiledtheclaimathandbeforeFIFA.Abriefsummaryofthepositionofthepartiesisdetailedincontinuation. a.PositionoftheClaimant 14.Inhisclaim,theplayerarguedthattheRespondentterminatedtheContractwithoutpriornoticeandduetosportingperformance,whichispursuanttotheconstantjurisprudenceoftheDRC,notajustcause. 15.TheplayerfurtherassertedthatheturneddownalucrativeofferfromanEgyptianclubtoplayfortheRespondent,whichcausedafurtherlossofopportunitytohim. 16.TheClaimantrequestedoutstandingremunerationofUSD40,000,correspondingtothesignaturebonusdueon11August2023,aswellascompensationofUSD140,000correspondingtotheresidualvalueoftheContractaswellasUSD50,000inthevalueofthelostopportunityforsigningfortheEgyptianclub. b.PositionoftheRespondent 17.Despitehavingbeeninvitedtodoso,theRespondentfailedtoprovideapositiontotheclaimwithinthestipulatedtimelimit. III.ConsiderationsoftheDisputeResolutionChamber a.Competenceandapplicablelegalframework 18.Firstofall,theDisputeResolutionChamber(hereinafteralsoreferredtoasChamberorDRC)analysedwhetheritwascompetenttodealwiththecaseathand.Inthisrespect,ittooknotethatthepresentmatterwaspresentedtoFIFAon23August2023andsubmittedfordecisionon26October2023.Takingintoaccountthewordingofart.34oftheMarch2023editionoftheProceduralRulesGoverningtheFootballTribunal(hereinafter:theProceduralRules),theaforementionededitionoftheProceduralRulesisapplicabletothematterathand. 19.Subsequently,themembersoftheChamberreferredtoart.2par.1oftheProceduralRulesandobservedthatinaccordancewithart.23par.1incombinationwithart.22lit.b)oftheRegulationsontheStatusandTransferofPlayersMay2023edition),theDisputeResolutionChamberiscompetenttodealwiththematteratstake,whichconcernsanemployment-relateddisputewithaninternationaldimensionbetweenaNigerianplayerandaMoroccanclub. 20.Subsequently,theChamberanalysedwhichregulationsshouldbeapplicableastothesubstanceofthematter.Inthisrespect,itconfirmedthat,inaccordancewithart.26par.1and2oftheRegulationsontheStatusandTransferofPlayers(May2023edition),andconsideringthatthepresentclaimwaslodgedon15February2023,theMay2023editioneditionofsaidregulations(hereinafter:theRegulations)isapplicabletothematterathandastothesubstance. b.Burdenofproof 21.TheChamberrecalledthebasicprincipleofburdenofproof,asstipulatedinart.13par.5oftheProceduralRules,accordingtowhichapartyclaimingarightonthebasisofanallegedfactshallcarrytherespectiveburdenofproof.Likewise,theChamberstressedthewordingofart.13par.4oftheProceduralRules,pursuanttowhichitmayconsiderevidencenotfiledbytheparties,includingwithoutl
