TheAustrianFederalOfficeforImmigrationandAsylum(BundesamtfürFremdenwesenundAsyl-BFA)istheauthorityresponsibleforfirstinstanceproceduresrelatingtoapplicationsforasylumandcertainotherissuesofforeignnationalsaswellasgrantingresidencepermitsbasedonhumanitariangrounds. AgainstalldecisionstakenbytheBFAthereisaneffectivejudicialremedyavailable.AppealsmaybefiledwiththeAustrianFederalAdministrativeCourt(Bundesverwaltungsgericht-BVwG).Asageneralrule,appealsbeforetheBVwGhavesuspensiveeffect.Evenifexceptionsareapplicable,theCourtalwayshastheopportunitytograntsuspensiveeffect,whereitdeemsitnecessary.
